After the highly publicized case of a man chewing the face off another man, the effects of these designer drugs, sometimes dubbed as the “zombie drug”, have called the attention of the government to exert efforts in controlling and forbidding the distribution of these drugs for human use. Considered illegal in forty-one states in the USA, the punishment for those who possess, sell or buy bath salts is imprisonment for up to 6 months and a $1,000 fine, plus a misdemeanour drug charge on their record.

Despite all these, users of mephedrone, MDPV, and methylone and other designer drugs are still able get their hands on these products. Manufacturers remain one step ahead of the drug regulators as they are able to skirt their way around laws that apply to the distribution of bath salts.

Some brick and mortar stores continue to have bath salts for sale simply by labelling them as other household products such as glass cleaners, stain removers and plant food. The fact that K-9 detection dogs cannot sniff out bath salts does not help in enforcing the sales ban.

It is also very easy to buy bath salts online without getting charged for committing a federal offense. Most online distributors simply add a disclaimer on their sites that indicates that their products are “not for human consumption”. Also, because of a 1986 analogue drug law, chemists are allowed to come up with new stimulants by simply making very small adjustments without the need for a new legislation each time this is done. This way, manufacturers could come up with countless new products with different chemicals but similar effects, and not get arrested for it. Other sites would simply state that their products are “research chemicals” and, thus, get away with it.
